Welcome to Chatwik. This Privacy Policy explains how Chatwik ("we", "us", "our") collects, uses, processes, and protects personal information relative to our website, communication platform, mobile app, widget, and related services (collectively, the "Services").

By accessing or using our Services, you understand and agree that we collect and use your information in accordance with this policy. This policy applies to all visitors, users, customers, and others who access the Services.

We operate as a **Data Controller** for the personal data of our users (such as account credentials and billing details) and as a **Data Processor** for customer communication data processed on behalf of our users (such as chat transcripts and inbox contents).

Important Note: We are committed to transparency. Chatwik is designed to put you in control of your data and customer communications. We do not sell your personal data under any circumstances.

2. Information We Collect

We collect information you provide directly to us, information collected automatically, and information from third-party integrations:

A. Information You Provide Directly

  • Account Details: When you register an account, we collect your name, email address, password, organization name, and optional phone number.
  • Billing Details: For subscription plans, we collect billing details and transaction history. Payment cards are processed securely via our PCI-DSS compliant third-party payment partner (e.g. Stripe) and are never stored on our servers.
  • Support & Communications: When you contact us for customer service or technical support, we collect the logs, emails, and attachments you share.

B. Information Collected Automatically

  • Usage & Log Files: We collect log files when you use our Services. This includes Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP), date/time stamps, referring/exit pages, and clicks.
  • Device Info: Hardware model, operating system version, browser identifiers, and network information.

C. Third-Party Channels & Integrations

Chatwik allows you to connect external communication channels. When you connect integrations (such as Facebook Messenger, WhatsApp, Telegram, or Email), we pull and store the incoming/outgoing message text, media assets, metadata, and sender profiles required to route these conversations to your Chatwik inbox.

D. Mobile App

  • Account & Login: When you sign in to the Chatwik mobile app, we collect your email address and authentication credentials to verify your agent account.
  • Device Permissions: With your permission, the app may access your camera, photo library, and microphone so you can attach photos, videos, or voice messages to customer conversations.
  • Push Notifications: We collect a device push token to send you alerts about new messages and conversation updates.
  • Diagnostics: We may collect crash logs and error reports to diagnose app issues and improve reliability.
  • AI Feature Consent: If you use Copilot or message translation in the mobile app, we record your consent choice locally on your device so data is only sent to third-party AI providers after you explicitly allow it.

3. How We Use Your Information

How we process your data to operate, support, and enhance our services.

We process your information for legitimate business purposes under the following legal bases:

Service Operations

To create and manage your account, process payments, authenticate logins, and display your multi-channel inboxes.

Customer Support

To diagnose server issues, answer customer service inquiries, and repair dashboard bugs.

Product Research & Development

To analyze user metrics to improve interface layouts, design new feature sets, and optimize message delivery speed.

Security & Compliance

To monitor for suspicious activities, investigate data breaches, prevent spam, and enforce our terms.

AI-Assisted Features

When you use Copilot or message translation, we process your draft messages, selected message text, and conversation context to generate suggestions or translations. This data is not used for advertising.

We will only contact you for marketing purposes if you have explicitly opted in. You can opt-out of marketing communications at any time by clicking the unsubscribe link in our emails.

4. AI-Assisted Features

How Copilot and message translation work, what data is sent, who receives it, and how your consent is obtained.

Chatwik offers optional AI-assisted features to help support agents work with customer conversations. These features are available in the Chatwik dashboard and mobile app and include:

  • Copilot — draft, improve, summarize, and respond to conversations
  • Message Translation — translate individual messages into your preferred language

What Data Is Sent

When you initiate an AI-assisted action, we may send the following to Chatwik's servers:

  • Your draft reply text or follow-up prompts you type
  • Message text you choose to translate, including sender context within that message
  • Conversation content and context needed to generate a suggestion (such as recent messages and contact details in the thread)
  • Conversation identifiers required to process the request

Who Receives the Data

To deliver AI-assisted features, conversation-related content may be processed by the following third-party AI service providers on our behalf:

  • OpenAI — processes data when you use Copilot (reply suggestions, summarization, text improvements, and tone changes)
  • Google Cloud Translation — processes message text when you use message translation

These providers act as subprocessors and process data only to deliver the requested AI output. They are contractually required to protect your data and may not use it for their own advertising purposes.

When Data Is Sent

Data is transmitted only when you explicitly choose an AI-assisted action. Examples include "Suggest reply", "Summarize conversation", "Improve reply", "Fix grammar", or "Translate" on a message. These features do not run automatically in the background.

Your Consent (Mobile App)

In the Chatwik mobile app, before any personal data is sent to a third-party AI provider for the first time, we display an in-app consent screen that explains what data will be sent, identifies who will receive it, and links to this Privacy Policy. Data is only transmitted after you tap "Allow and continue." If you choose "Not now," no data is sent and the AI feature will not run.

Your Choice: You are always in control. AI suggestions and translations are optional — you can review, edit, or discard them before sending any message to a customer. We do not use AI feature data for advertising or sell it to third parties. Third-party AI providers are required to protect data under contractual and security safeguards consistent with this policy.

5. Information Sharing & Disclosure

When and why we share your information with third parties.

We value your privacy and only share your personal data under the following circumstances:

  • Service Providers: We share data with trusted subprocessors (e.g. cloud hosting providers, database backups, email delivery systems, analytics services) to support our platform operations. They process data under strict confidentiality obligations.
  • AI Service Providers: When you use Copilot or message translation, conversation-related content (such as draft replies, selected message text, and conversation context) may be shared with third-party AI providers — including OpenAI (for Copilot suggestions) and Google Cloud Translation (for message translation) — solely to generate agent-facing output. These providers are contractually required to protect your data and may not use it for their own advertising purposes.
  • Compliance with Laws: We may disclose your data if we believe it is reasonably necessary to comply with a law, regulation, legal process, or governmental request.
  • Business Transfers: In the event of a merger, acquisition, restructuring, or asset sale, your information may be transferred. We will notify you prior to the transfer of data.

No Selling of Data: Chatwik does not sell, rent, or lease your personal information or your customers' data to any third-party advertisers or data brokers.

6. Cookies & Tracking Technologies

Cookies are small text files placed on your device to store preferences and monitor system usage.

We use both session cookies (which expire when you close your browser) and persistent cookies (which remain on your device for a set period) to:

  • Keep you securely logged in to the Chatwik dashboard.
  • Remember configuration preferences (e.g. language, view states).
  • Understand how users navigate through our website to improve UX.

You can control cookie settings in your individual browser options. Disabling cookies may limit your ability to access certain parts of our Services.

7. Data Security & Retention

How we protect, encrypt, and store your data, and how long we retain it.

We implement comprehensive technical and organizational measures designed to secure your personal data against accidental loss, unauthorized access, alteration, and disclosure:

AES-256 Encryption

All data is encrypted in transit using SSL/TLS and at rest using advanced encryption standards.

Access Control

Strict interior permission controls ensure only authorized personnel have system credentials.

Retention Limits

We store data only as long as your account remains active or to fulfill contract requirements.

If you choose to delete your Chatwik account, we will initiate a purge of all database tables containing your personal details and integrated messages within 30 days, subject to legal storage requirements.

8. Your Rights & Choices

Depending on your residency (such as the European Union under GDPR or California under CCPA), you have specific legal rights concerning your personal information:

Right of Access & Rectification:

You can request a copy of the personal data we hold and request corrections to inaccurate logs.

Right of Erasure (To Be Forgotten):

You can request that we delete all your account profiles, conversation databases, and usage data.

Right to Restrict Processing & Portability:

You can object to automated data processing and request download archives of your inbox transcripts.

9. International Data Transfers

How we manage the transfer of data across international borders.

Chatwik is hosted globally. Personal data collected by us may be stored and processed in servers situated in regions other than your home country.

When we transfer personal data from the EU or UK to countries outside these jurisdictions, we ensure that appropriate safeguards are in place. We utilize Standard Contractual Clauses (SCCs) approved by the European Commission to ensure a level of data protection equivalent to GDPR.

10. Children's Privacy

Our policy regarding protection of children's data.

Our Services are not designed for or directed to children. We do not knowingly collect or solicit personal information from anyone under the age of 13.

If we learn that we have accidentally collected personal data from a child under 13, we will immediately delete that information from our database. If you suspect that a child under 13 has provided personal details to us, please notify us at support@chatwik.com.

11. Policy Changes

How we notify users about modifications to this privacy document.

We may update our Privacy Policy from time to time to align with structural alterations, compliance laws, or feature releases.

We will notify you of any material changes by sending an email notice to the address registered to your account and by displaying a conspicuous notice on our dashboard. We will also update the "Last Updated" timestamp at the top of this document. We encourage you to review this policy periodically.
