1. Acceptance of Terms

An introduction to these Terms, agreement eligibility, and the contract between Chatwik and you.

Welcome to Chatwik. These Terms of Service ("Terms") govern your access to and use of our website, real-time communication platform, chat widget, and related APIs or applications (collectively, the "Services").

By signing up for an account, accessing the dashboard, or utilizing any part of our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any clause, you must immediately cease accessing the Services.

You must be at least 18 years old, or the legal age of majority in your jurisdiction, and fully competent to enter into the terms, conditions, obligations, and representations set forth in these Terms.

Important Contract Note: These Terms constitute a legally binding agreement between you and Chatwik. Please read them thoroughly before initializing your multi-channel support setups.

2. User Accounts & Security

Responsibilities regarding account registration, credentials security, and authorized use.

To access the full features of the Chatwik platform, you must register for an account by providing accurate, current, and complete profile information.

  • Credential Confidentiality: You are entirely responsible for safeguarding your login password and API tokens. We encourage using strong, unique passwords and multi-factor authentication where supported.
  • Account Activities: You accept full responsibility for all activities, messages sent, integrations added, and changes configured under your registered profile.
  • Unauthorized Use Notification: You must notify us immediately at support@chatwik.com upon discovering any security breach or unauthorized access to your workspace inboxes.

3. License & Restrictions

The scope of usage rights granted to you, and prohibited actions on the platform.

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Chatwik platform solely in accordance with these Terms.

Prohibited Activities

You agree not to engage in, or assist others in engaging in, any of the following prohibited activities:

  • Attempting to bypass platform security measures, vulnerability probing, or loading malware onto Chatwik servers.
  • Using the Services to distribute unsolicited messages, automated spam, or harassing communication.
  • Decompiling, modifying, translating, or reverse-engineering any source code or styling assets belonging to Chatwik.
  • Accessing the Services via unauthorized bots, scrapers, or automatic scripts except through verified official API endpoints.

4. Subscriptions & Payments

Billing cycles, secure payment integrations, cancellations, and refund clauses.

Certain tiers of the Services are billed on a recurring monthly or annual subscription basis.

  • Billing Authorization: By selecting a paid plan, you authorize Chatwik to charge the recurring subscription fees to your designated payment card.
  • Secure Processing: Payment cards are processed through PCI-DSS secure third-party billing infrastructures. We do not store raw card numbers.
  • Cancellation Policy: You can cancel your subscription from your dashboard billing settings at any time. The cancellation takes effect at the end of your current billing cycle, and you will retain access until then.
  • Refund Policy: We offer a 7-day refund window for all subscription plans and unused add-ons. Refund requests must be submitted to our support team within 7 days of the transaction date.

5. Your Content & Data

Your ownership rights and responsibilities over messages and channel contents processed on Chatwik.

You retain all ownership, copyrights, and intellectual property rights in the chat logs, user profile pictures, and customer messages that you routing through the Chatwik platform.

By transmitting content through our platform, you grant us a limited license to store, parse, index, and display your data exclusively to provide the customer support Services to you and your team.

You warrant that your customer communication data complies with applicable laws and does not violate the intellectual property, confidentiality, or privacy rights of any third party.

6. Intellectual Property Rights

Chatwik's ownership of core software code, platform design, visual branding, and assets.

The Chatwik platform, website styling, backend microservices, core databases, logos, design templates, and assets are the exclusive property of Chatwik and our licensors.

You may not use our trademarks, brand layouts, icons, or design elements in connection with any third-party product or service without obtaining our express prior written consent.

7. Third-Party Integrations

Your responsibilities when connecting external APIs like WhatsApp, Facebook, or Telegram.

Chatwik interfaces with third-party social media, messaging, and email channels (such as the Meta WhatsApp Business API, Facebook Messenger, and Telegram Bot API).

Your connection and use of these third-party channels are governed by their respective terms of service and developer policies. Chatwik is not responsible or liable for any suspensions, fees, or changes in service enacted by those third-party providers.

8. Disclaimer of Warranties

Chatwik is provided on an 'as-is' basis without any warranties or guarantees of performance.

Platform Disclaimer

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPLICITLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, TIMELY, OR COMPLETELY FREE OF ERRORS, OR THAT DATA TRANSMITTED VIA THE CHAT WIDGET WILL NEVER BE SUBJECT TO NETWORK DRIFT OR DELAY.

9. Limitation of Liability

Liability limitations governing damages and claims resulting from service usage.

Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHATWIK AND ITS DIRECTORS, EMPLOYEES, OR PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF REVENUE, PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO CHATWIK DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Changes & Termination

Modifications to these terms, account suspensions, and service termination details.

We reserve the right to suspend or terminate your account and access to the dashboard at any time, with or without notice, if we believe you have violated these Terms or engaged in behavior detrimental to other platform tenants.

We may modify these Terms of Service from time to time to account for features, integrations, or legal guidelines. Revisions will become effective immediately upon posting. Your continued use of the Services after such posting constitutes your acceptance of the revised Terms.
